1. Acceptance of Terms
By accessing or using AiReply ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. These terms constitute a legally binding agreement between you ("User," "Doctor," or "Practice") and AiReply Technology ("we," "our," or "us"), a registered MSME (Udyam: UDYAM-GJ-05-0082336).
2. Service Description
AiReply provides an AI-powered digital presence platform for medical practices, including:
- WhatsApp AI Receptionist: Automated patient query handling via WhatsApp Business API
- AI Image Generation: NMC-compliant health education creatives
- Smart Advertising: AI-generated Meta Ads campaigns (Facebook and Instagram)
- Social Media Autopilot: Automated posting to Facebook, Instagram, Threads, and Telegram
The Service is designed for registered medical practitioners, dental practitioners, AYUSH practitioners, and allied healthcare professionals operating within India.
3. User Eligibility & Responsibilities
- You must be a registered medical, dental, AYUSH, or allied healthcare professional with a valid registration from the appropriate regulatory body (NMC, State Medical Council, DCI, etc.)
- You must provide accurate clinic information including name, address, registration number, and specialization
- You are responsible for verifying the accuracy of AI-generated content before it is published or sent to patients
- You must ensure your use of AiReply complies with all applicable laws and professional regulations
- You must not use the Service for any illegal, fraudulent, or unauthorized purpose
4. AI Disclaimer
AiReply's AI is NOT a substitute for medical judgment.
- The AI receptionist does not diagnose, prescribe, or provide medical treatment recommendations
- AI-generated content is for informational and educational purposes only
- The doctor retains full responsibility for all medical decisions and patient care
- AI responses should be reviewed by the practitioner, especially for complex or sensitive queries
- AiReply is not liable for any clinical decisions made based on AI-generated information
5. NMC Compliance — Shared Responsibility
AiReply provides an NMC compliance engine that screens AI-generated content against the Indian Medical Council (Professional Conduct, Etiquette and Ethics) Regulations, 2002. However:
- The compliance engine is a tool, not a guarantee. It may not catch every potential violation.
- The medical practitioner is ultimately responsible for ensuring all published content complies with NMC regulations
- If you believe any AI-generated content violates NMC guidelines, do not publish it and report it to us at admin@aireply.in
- AiReply is not liable for regulatory action taken against practitioners for content published through the platform
6. Credit System
- The Service operates on a credit-based system. Each AI operation consumes credits.
- Monthly credits are included with each subscription tier and reset at the beginning of each billing cycle
- Unused monthly credits roll over to the next month only if the plan is renewed within 48 hours of expiry. If the plan lapses beyond 48 hours, unused monthly credits expire
- Top-up credit packs are available for purchase and never expire
- Top-up credits are consumed only after monthly credits are exhausted
- Credits are non-refundable and non-transferable
7. Subscription & Billing
- Paid subscriptions are billed monthly in Indian Rupees (INR)
- Payments are processed through secure third-party payment providers
- You may upgrade or downgrade your subscription at any time. Changes take effect at the next billing cycle.
- You may cancel your subscription at any time. The Service will remain active until the end of the current billing period.
- Since a free trial is provided before any payment, all subscription payments and credit purchases are non-refundable. See our Refund & Cancellation Policy for full details. Exceptions may apply for duplicate charges or technical billing errors.
8. Account & Data
- You are responsible for maintaining the security of your account credentials
- You must notify us immediately if you suspect unauthorized access to your account
- You retain ownership of your clinic data, content, and patient information
- AiReply has a limited license to process your data solely for providing the Service
- Upon account termination, your data will be permanently deleted within 30 days
9. Third-Party Integrations
AiReply integrates with third-party services including WhatsApp (Meta), Facebook, Instagram, Threads, Telegram, and Razorpay. Your use of these integrations is subject to the respective third-party terms of service:
AiReply is not responsible for any changes, outages, or policy updates from third-party services that may affect your use of the platform.
10. Intellectual Property
- The AiReply platform, including its AI models, design, code, and branding, is the intellectual property of AiReply
- Content generated by AI on your behalf (images, posts, ad copy) is licensed to you for use in your medical practice
- You may not resell, redistribute, or sub-license AI-generated content to third parties
11. Limitation of Liability
To the maximum extent permitted by Indian law:
- AiReply is provided "as is" without warranties of any kind
- We do not guarantee uninterrupted or error-free service
- We are not liable for any indirect, incidental, special, or consequential damages
- Our total liability shall not exceed the amount paid by you in the 3 months preceding the claim
- We are not liable for any actions taken by regulatory bodies against medical practitioners
12. Termination
- We may suspend or terminate your account if you violate these Terms
- We may terminate accounts that remain inactive for more than 12 months
- You may terminate your account at any time by contacting admin@aireply.in
- Upon termination, your right to use the Service ceases immediately
13. Governing Law & Disputes
These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts in Bhavnagar, Gujarat, India.
14. Changes to Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated via email or dashboard notification at least 15 days before taking effect. Continued use after changes constitutes acceptance.
